Law enforcement, court-verdict system improves, says minister

VietNamNet Bridge – In his report on the implementation of court verdicts and on the work of law enforcement agencies in 2009, Minister of Justice Ha Hung Cuong told the National Assembly yesterday, November 4, that progress has been made when compared to previous years.

He said the success in 2009 should be attributed to the Government’s timely instructions on the implementation of the Law on Enforcement of’ Civil Judgements and the National Assembly’s Resolution, which put the law into practice.

In addition, the renovations and flexibility demonstrated by leaders at the grassroots level also played an important role in putting the law into practice.

However, Cuong conceded that limitations still existed, particularly in the number of civil judgements that were delayed. When compared to 2008, this year’s delays in the implementation of civil judgements and in the guiding documents of the law exceeded those of last year.

For the 2010 plan, Cuong said, with a strong commitment from the Government, his ministry would make comprehensive enforcement of the law a key task. The plan would also focus on renovating management and providing clear instructions on how to enforce civil judgements.

The Ministry of Justice has also been assigned to revise the Penal Code next year in order to actively prevent and combat crimes through measures that would deter, educate, convert and reform offenders into honest people.

The Ministry of Justice is also planning to amend and supplement the Ordinance on Enforcement of Imprisonment Sentences law.

The Minister of Public Security, Le Hong Anh, followed Cuong at the Assembly and spoke about preventing and combating crimes.

Generally speaking, in 2009 the country’s political stability has been well maintained, along with social law and order, Anh said.

The minister gave credit to an effective campaign of information, education and communications, which contributed to the overall stability of the country and society.

He asked the National Assembly and Government to exert further efforts into enabling the full implementation of the current administrative reforms and to strengthen the capacity of the public apparatus.

“To make sure that legal bodies are able to perform their tasks, the government should invest in advanced technology,” Minister Anh said.

The deputies also heard reports about the performance of the People’s Supreme Court and the People’s Supreme Procurary, which was presented by Chief Judge Truong Hoa Binh and Director Tran Quoc Vuong, respectively.

In its appraisal report, a representative from the Judiciary Committee of the National Assembly said that the reports presented by the Government, the Supreme People’s Court and the Supreme People’s Procuracy were of high quality. The reports comprehensively analysed the work required to prevent and combat crimes and legal violations.

The committee asked the Government, the court and the procuracy to submit their proposals on the restructuring of legal bodies to the National Assembly for approval as soon as possible. They were also asked to accomplish the tasks of compiling the laws that have been assigned to them in accordance with the given timeline.

In the afternoon, the deputies discussed reports by the director of the Supreme People’s Procuracy and the chief judge of the Supreme People’s Court, as well as those on preventing and combating crimes and implementing court judgements.

They held that although the work to prevent and combat crimes had yielded positive results, many types of crimes had become more complicated in Viet Nam, including those of women and children trafficking and drug smuggling crimes.

In the time ahead, this work would have to be carried on with uniform measures, they said, stressing the need to raise the efficiency of legal education, State management and the judicial sector’s working ability.

Deputies Ha Cong Long from the Central Highland province of Gia Lai, Chu Son Ha from Ha Noi and Vu Duy Hoa from central Thanh Hoa Province wanted to further intensify the training of personnel working in the judicial sector in order to make them professionally and morally meet the challenges of their jobs.

Meanwhile, deputy Tran Tien Dung from central Ha Tinh Province called for increased co-ordination between schools, families, social organisations and functional agencies in preventing and combating crimes. He also spoke of the need to create a healthy environment for young people.

Also yesterday afternoon, deputies raised funds to give relief to the victims of Tropical Storm Mirinae, which wreaked havoc on central Viet Nam on Tuesday.
